BALLPARKS OF AMERICA COVID-19 AND WEATHER-RELATED CANCELLATION, CREDIT, AND REFUND POLICIES
For events Ballparks of America (“BoA”) hosts for our tournament partners (including Game 7 Baseball and Greater Midwest Baseball), our event partner’s cancellation and refund policies will apply.
For BoA’s programs and events, all payments made for BoA programs and events are non-refundable with the exception of COVID-19 or weather-related cancellations of tournaments or partial tournaments as set out below.
Tournament entries and other event reservations at BoA require an initial payment, which may be a deposit or full payment depending on the timing of the reservation.
BoA entry pay schedules may vary by event and will be provided to each team individually.
BoA reserves the right to remove teams or participants from programs, without refund of any prior payments, credit, or other future consideration if teams fail to timely make scheduled payments that have been previously communicated to the team through the registration process or otherwise.
TOURNAMENT CANCELLATIONS OR A TEAM’S INABILITY TO TRAVEL:
BoA has a limited number of spaces available for its summer events, and many of those events currently have waiting lists. For BoA’s Week Long and other team and individual events from Memorial Day to Labor Day, the following cancellation policy will be in effect for 2021 due to the potential continued impact of COVID-19.
If a tournament or event is canceled in its entirety due to COVID-19, weatherrelated cancellation, or another Act of God, BoA will first work to find a team an alternative event in 2021. If no such event is available, BoA will work to identify a workable 2022 event and, with team approval, will lock the team in for that event at the 2021 price. If BoA and the team cannot reach agreement, BoA will refund teams (or individuals for individual events) one hundred percent of any amount they paid to BoA to date.
If a team (or individual for an individual event) is unable to travel to Branson, Missouri for their scheduled summer event due to a governmental restriction on travel from their country or state, BoA will follow the same process as set out for tournament cancellations above. For purposes of this policy, a mandatory quarantine period will be considered a “governmental restriction on travel” if it requires returning travelers to quarantine for 7 days or more.
If a summer event has to be cancelled or ends early due to COVID-19, weather, or any other Act of God, BoA will follow the following credit schedule:
For events involving 5 game guarantees or greater:
1 game played = 60 percent credit
2 games played = 40 percent credit
More than 2 games played = no credit
For events involving 4 game guarantees or less:
1 game played = 50 percent credit
More than 1 game played = no credit
For all cancellations or withdrawals other than those identified in this policy, no
refund or credit will be issued.
COVID-19 TESTING AND WITHDRAWAL DUE TO POSITIVE TESTS OR EXPOSURE:
Based on the improvements that have occurred with COVID-19 and the increased availability and implementation of COVID-19 vaccines, BoA does not currently anticipate requiring pre-tournament testing for teams (players and coaches). If a team (or individual for an individual event) is required to withdraw from of a summer event due to a positive COVID-19 test or a team’s exposure to COVID-19, either immediately before or during an event, BoA will handle any such incident on a case by case basis. Refunds are not anticipated, but BoA will work with the team to provide a credit for future tournaments.
If in the unlikely event that a significant surge or spike in COVID-19 positivity occurs either before the summer or during the summer, BoA reserves the right to request that some or all teams (players and coaches) participating in a summer event present evidence of a negative COVID test upon arrival on campus.
APRIL 15, 2021 CANCELLATION DEADLINE
If a team is uncomfortable with any terms of this policy, the team may withdraw before April 15, 2021 and will receive a refund of all monies paid to BOA less the team’s $1000 deposit. Alternatively, the team can use the $1,000 deposit as a credit for a 2022 event. If a team does not cancel before April 15, 2021, the terms of this policy will apply to any cancellation.
USE OF CREDITS ISSUED UNDER THIS POLICY
All credits issued to a team or individual under this policy must be used on an event starting no later than September 5, 2022 (Labor Day).
