1. About These Terms

These SMS Terms & Conditions ("SMS Terms") govern the sales and marketing text message program (the "Program") operated by Ballparks of America, LLC, doing business as Ballparks of America ("Ballparks of America," "we," "us," or "our"), 1000 Pat Nash Drive, Branson, MO 65616.

By providing your mobile phone number and agreeing to receive text messages from us, you accept these SMS Terms and our Privacy Policy. If you do not agree, do not enroll in the Program, or opt out at any time by replying STOP.

2. What Messages You Will Receive

The Program sends sales and marketing messages, which fall into two kinds:

a. Sales conversations. One-to-one text conversations with a member of the Ballparks of America team about tournament availability and pricing, registration options, team lodging, facility and travel questions, batting cage or field rentals, birthday parties and entertainment bookings, or scheduling a phone call.

b. Marketing and promotional messages. Early bird registration deadlines, tournament and season announcements, camps, clinics and league openings, Grand Slam Entertainment offers (batting cages, escape rooms, laser tag, arcade), Pro Shop and merchandise promotions, and other offers.

What the Program does not send. The Program does not send registration confirmations, payment or balance-due notices, rosters, schedules, or tournament check-in and scheduling notifications. Those communications are handled separately through our third-party registration platform and are not governed by these SMS Terms. Opting in or out of the Program does not change whether you receive them.

3. How to Opt In

You may enroll in the Program by:

Your consent is recorded with a date and time stamp, the method of opt-in, and the disclosure language shown to you at the time.

4. Consent Is Not a Condition of Purchase

Agreeing to receive text messages is not a condition of registering a team, purchasing anything from us, or using any of our services. You can register, book, and buy without joining the Program.

5. Message Frequency

Message frequency varies. Sales conversations depend on how often you and our team exchange texts. For marketing messages, you can expect up to 6 messages per month.

6. Cost

We do not charge you for text messages. Message and data rates may apply — standard messaging and data charges from your mobile carrier apply to messages you send and receive. Contact your carrier for details about your plan.

7. How to Opt Out

Reply STOP to any message from us to end the Program. We also honor END, CANCEL, UNSUBSCRIBE, QUIT, and OPTOUT. You will receive one final message confirming that you have been unsubscribed, and we will not text you again from that number.

Opting out ends the sales and marketing messages described in these SMS Terms. It does not affect communications sent through our registration platform, and it does not cancel a registration or booking. We may still contact you by email or phone where appropriate.

You may also opt out by emailing optout@ballparksofamerica.com or calling (417) 464-6333 during business hours. You are never required to visit a website, create an account, or log in to opt out.

If you opt out and later want to rejoin, reply START to the same number or opt in again through any method in Section 3.

9. Eligibility

The Program is available to individuals 18 years of age or older with a mobile number issued by a United States wireless carrier. Youth participants may not enroll. Parents, legal guardians, coaches, and team organizers may enroll on their own behalf only — you may not enroll another person's mobile number, including a child's.

10. Your Mobile Number

By enrolling, you confirm that you are the account holder or an authorized user of the mobile number you provide, and that you have authority to consent to receive text messages at that number. If your mobile number changes, is disconnected, or is transferred to another person, you agree to notify us promptly at optout@ballparksofamerica.com or (417) 464-6333 so we can update our records.

11. Carriers and Delivery

The Program is supported by most major United States wireless carriers, including AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, Cricket Wireless, Boost Mobile, MetroPCS, and Google Voice. Carrier support may change without notice, and not all carriers are supported.

Wireless carriers are not liable for delayed or undelivered messages. We cannot guarantee that every message will be delivered, or that it will be delivered without delay — delivery depends on your carrier, your device, and network conditions outside our control.

To receive messages you must have a text-capable device with an active service plan.

Your mobile number, your text message consent, and the content of your messages with us are handled as described in our Privacy Policy.

We do not sell or share mobile numbers, SMS consent, or text message content with third parties or affiliates for their own marketing or promotional purposes. We share this information only with the service providers that operate the Program on our behalf — such as our messaging platform and wireless carriers — and only so they can deliver messages for us.

13. Please Don't Text Us Sensitive Information

Text messaging is not a secure channel. Do not send us payment card numbers, bank account details, Social Security numbers, medical information, or other sensitive personal information by text. If you need to share something like that, call us at (417) 464-6333.

14. Changes to These SMS Terms

We may update these SMS Terms from time to time. Changes take effect when posted on this page, and we will update the Effective Date above. Your continued participation in the Program after a change means you accept the updated SMS Terms. If a change is material, we will notify enrolled participants by text or email before it takes effect.

15. Governing Law

These SMS Terms are governed by the laws of the State of Missouri, without regard to its conflict of law provisions. Any dispute relating to the Program will be brought in the state or federal courts located in Taney County, Missouri, and you consent to the jurisdiction of those courts.
